Appealing a decision

If your application is not recommended for support and you believe that the proper process was not followed, you may submit a request for review.

All requests for review must be made in writing to the Director of Arts Tasmania. Your request must be received within 28 days from the date of Arts Tasmania notifying you of the decision about your application and include the reasons for requesting a review.

A request may be made on one or more of the following grounds:

(a) that a breach of the rules of natural justice happened relating to the making of the decision*;

(b) that procedures that were required under the Cultural and Creative Industries Act 2017 to be observed relating to the making of the decision were not observed;

(c) that the person who purported to make the decision did not have jurisdiction to make the decision;

(d) that the decision involved an error of law (whether or not the error appears on the record of the decision);

(e) that the decision was induced or affected by fraud;

(f) that there was no evidence or other material to justify the making of the decision;

(g) that the decision was otherwise contrary to law.

Any reviews requested on these grounds will be undertaken by the Deputy Secretary of the Culture, Arts and Sport Division of the Department of State Growth.

*Natural justice includes the right to be heard, the right to be treated without bias and to have decisions made based on relevant evidence. Applicants must be given a reasonable opportunity to present information before a decision is reached that might adversely affect them.
